It's slightly more complicated than that. the original court order got ruled technically invalid and the lower court was supposed to revise it, and so trump is contending that he's not currently in violation of any order. he's probably wrong about that, but he's at least pretending to respect the SCOTUS decision. once you start deporting citizens there's a lot fewer technicalities to hide behind.
